§ 83. MARSHAL'S DEPUTIES.

  • The mayor and board of aldermen may allow the marshal to appoint one or more deputies under himself who may be acceptable to the mayor and board of aldermen and for such time as the mayor and board of aldermen may deem wise, but the number of deputies, if any, required at any time shall be determined by the mayor and board of aldermen, and unless the duties of the office of marshal shall require help in the opinion of the mayor and board of aldermen they shall refuse to approve the appointment of any deputy that may be nominated by the marshal, and when one or more deputies are appointed by the mayor and board of aldermen on nomination of the marshal, the minutes of the mayor and board of aldermen shall so show and for what time such appointment, or appointments are made, and when one or more deputy marshals have been appointed by the mayor and board of aldermen, they shall then fix his salary to be paid monthly out of the treasury on allowance of the mayor and board of aldermen as other claims, and the same shall be paid if the services were honestly and efficiently rendered. All deputies so appointed shall take and subscribe an oath as to their official duties substantially in the same form as that required of the marshal, and which shall be preserved with the marshal's bond, and the acts of all such deputies as such, shall be as that of the marshal and the marshal shall be liable on his official bond for all acts of his deputies to the same extent as if the acts of his deputies were performed by himself under his own bond which he and all his deputies shall act under, provided the marshal shall have the right to demand and receive from each deputy under him an indemnifying bond payable to himself, in such sum, and with such sureties as the marshal shall require, conditioned substantially in accordance with that of his own bond, for his own protection, and that of his official bond, if he so elects, as a condition precedent to all deputies entering upon their duties, taking and subscribing the oath by each deputy shall be a condition precedent to entering upon their duties as deputies.
