§ 91. ADOPTION OF STATE MISDEMEANORS.

  • That all offenses against criminal laws of the State of Mississippi, occurring within the corporate limits of this municipality as now fixed or may hereafter be legally established, not amounting to a felony, shall be deemed violations of the laws, of this municipality and punishable as such, and upon conviction thereof, the same punishment shall be imposed by this municipality as is provided by the laws of this state (except only where such state laws provide for imprisonment and then the only change in the law shall be this: Where the state law provides for imprisonment in the county jail or upon the county farm the same shall be construed to mean in the municipal prison of this municipality); provided always that this section shall not be construed as interfering with or limiting the jurisdiction of the proper state tribunals over such offenses against the state.

    Amendment note— The provisions compiled as section [91] of this Charter were added to the Charter as an amendment by an ordinance recorded in Minute Book 6, page 242.
